In California, the Department of Real Estate acts as the licensing
and regulatory agency overseeing licensed real estate
professionals. Licensed real estate professionals include real
estate salesmen and brokers. As part of its statutory charter, the
Department of Real Estate is empowered to seek disciplinary
action against licensees who violate specific sections of the
Business and Professions Code.
The Department publishes a monthly list summarizing its
enforcement actions, a list that names the licensees involved, the
basis for discipline and the current status or outcome of the
disciplinary action. In July of 2011, the Department’s Summary
of Enforcement Actions revealed that approximately forty (40)
licensees had their real estate license revoked for violating various sections of the
Business and Professions Code, and several others voluntarily surrendered their
license. There are also suspensions and revocations with restricted licenses.
Revocations can occur for many reasons, including willfully disregarding or violating
the Real Estate Law, being found guilty of a felony, engaging in fraud or dishonest
dealing, and in the case of brokers, failing to exercise reasonable supervision
over the activities of salespersons. For a more complete list see the Business and
